General Conditions of Use of MAXYMIZE Business

1. Acceptance of the Terms

Welcome to MAXYMIZE Business (www.maxymizebusiness.com). By using our website and our services, you automatically accept these Terms of Service. If you do not accept these terms, please do not use our services.

We reserve the right to amend these terms at any time. Amendments take effect immediately upon publication on the website.

4. Bookings and Payments

4.1 Booking a Consultation

  • Bookings are made through the integrated Google Calendar
  • Email confirmation is required to validate the booking
  • The services are subject to availability
  • We reserve the right to decline inappropriate bookings

4.2 Fees and Payments

  • Fees are communicated before the booking is made
  • Payments are handled according to the agreed terms
  • All fees are stated in Euro and include VAT where applicable
  • Prices may change without prior notice

4.3 Cancellations and Refunds

  • Free cancellation: up to 24 hours before the appointment
  • Late cancellation: within 24 hours, subject to a 50% charge
  • No-show: no refund for failure to attend
  • Refunds: processed within 14 days of the request
  • Emergencies: assessed on a case-by-case basis

5. Intellectual Property

5.1 Website Content

All the content of the website (texts, images, logos, design, code) is owned by MAXYMIZE Business and protected by copyright. Reproduction without authorisation is prohibited.

  • Training materials and guides: copyright MAXYMIZE Business
  • Website code: protected intellectual property
  • Methodologies and frameworks: business know-how

5.2 Third-Party Content

The website uses third-party services (Google, Spline, etc.) whose content remains the property of the respective owners. Use is compliant with their licences.

6. Confidentiality and Non-Disclosure

  • We do not guarantee specific results or a given ROI
  • Results depend on external factors beyond our control
  • Recommendations are based on professional analysis but are not infallible

7.2 Website Operation

  • We do not guarantee continuous availability of the website (99.9% uptime target)
  • We are not liable for interruptions due to maintenance
  • We are not liable for technical issues caused by third parties
  • Users are responsible for the security of their own devices

⚠️ Exclusions of Liability

MAXYMIZE Business is not liable for direct, indirect, incidental or consequential damages arising from the use of the services, except as provided for by applicable Italian law.

8. Force Majeure

MAXYMIZE Business shall not be liable for delays or failures to perform caused by events of force majeure, including but not limited to:

  • Pandemics or health emergencies
  • Internet service outages
  • Power blackouts
  • Governmental or legislative measures
  • Strikes or protests
  • Cyber attacks
  • War or terrorism

9. Dispute Resolution

9.1 Amicable Procedure

In the event of a dispute, we undertake to seek an amicable solution through direct dialogue. Please contact us at info@maxymizebusiness.com for any matter.

9.2 Jurisdiction

These terms are governed by Italian law. For any dispute not settled amicably, the competent court is that of the consumer's place of residence or of the registered office of MAXYMIZE Business.

9.3 Mediation

Before bringing proceedings before the courts, the parties undertake to attempt mediation before an accredited mediation body.

10. Changes to the Terms

We reserve the right to amend these Terms of Service at any time. Changes will be communicated through:

  • Publication of the new version on the website
  • Email notification to registered clients for material changes
  • A prominent notice on the homepage for significant changes

Continued use of the services after the changes constitutes acceptance of the new terms.

11. Severability

Should any provision of these terms be declared invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid one that comes as close as possible to the original intent.

12. Use of artificial intelligence systems in our services

In carrying out our work we use artificial intelligence systems as a supporting tool. We state it here because clients are entitled to know before entrusting us with a project, and because it is the same transparency we ask of those we advise.

Where it is involved

  • Software development: generating and reviewing code, always read and tested by us.
  • Research and writing: first drafts, rewording, cross-checking of sources that are then verified against the original texts.
  • Graphic and training materials: drafts and illustrations, which may be generated or reworked with AI tools.
  • Analysis of data and documents provided by the client, within the limits set out below.

What remains ours

The intellectual work, the professional choices and the responsibility for the result remain entirely with MAXYMIZE BUSINESS. Nothing is delivered without human review. Artificial intelligence is a tool in our hands, not a substitute for professional judgement, and it decides nothing concerning the client or any third party.

What we never upload

  • Credentials, access keys, payment data.
  • Health data, beliefs or other special categories, unless on the client's written instruction and with an established legal basis.
  • Entire archives of personal data of the client's employees or customers: we work on data reduced to the minimum necessary, or made non-attributable to identified individuals.
  • Documents covered by contractual restrictions that rule it out.

We use tools on professional terms that exclude the use of content for model training, and with which a data processing agreement is in place. Clients may at any time request that a specific piece of work be carried out without these tools.
